TOPIC: LEAN CONSTRUCTION:  Maximizing value and minimizing waste

Mr. Jeff Esgar will share how this approach to scheduling and planning does many things to assure a realistic and reliable schedule that includes:
- Subcontractor buy-in / Realistic durations
- Collaboration & coordination between subcontractors creating reliable handoffs
- Tracking subcontractor performance that allows for continuous improvement
Jeff Esgar has worked in the construction industry for over 22 years. He is a Certified Professional Constructor and a LEED Accredited Professional.  Throughout his construction career, Jeff has served as Field Engineer, Project Engineer, Field Superintendent, Project Superintendent and Project Manager.  Jeff has worked on numerous types of projects including Medical, Hospitality, Office, Clean Room, Schools and Aviation.  He is currently Sundt Construction’s Assistant Operations Manager for the Arizona District.
Jeff also serves as the Lean Champion for Sundt and is the Chairman of the Lean Construction Committee for Sundt Construction.

TOPIC: “AIA CM Agreements Update and Recent Changes in Bonding Requirements.”

Notes: AIA Revised CM Agreements. The American Institute of Architects (AIA) has updated its agreements between construction managers and owners, which restructures the relationship between the owner and the CM and clarifies the services that a construction manager performs on a project.  One change that estimators need to be aware of is the responsibility of the CM to prepare and update all cost estimates for a project including contingencies and projections of their effect on the budget. The 2009 updates focus on the family of documents involving the Construction Manager, either as adviser or constructor, and agreements involving the Owner and the Construction Manager as Constructor. The 2009 documents include changes to correspond to the updated A201-2007 General Terms and Conditions.

Bonding Update:  Recent Changes Imposed by Owners and Developers.
The current economic climate has precipitated many changes in project requirements especially from a financial standpoint. One of these changes includes bonding requirements imposed by owners and developers even in regard to private projects. In addition, public projects are subject to bonding requirements vis-à-vis the public entity. Special attention should be paid to these bonding requirements regarding both performance and payment bonds and how they affect the financial parameters for each project.

The MWM&F Construction Law Group handles all facets of the construction industry including representing owners, developers, contractors, suppliers, bonding companies and design professionals in drafting of contracts and preparing, pursuing, defending and resolving construction claims.
